Contest Rules « KNOW YOU BETTER 2009 CONTEST» |
Article 1: ORGANIZER Société Air France SA, Bobigny Trade Register number n°420495178 is organizing an online contest that is free of charge and without obligation to purchase, from August 7, 2009 9:00 a.m. to September 20, 2009, 23:59 p.m., Montreal time. Article 2: PARTICIPATION The contest is open to Canadian residents ages 18 and over. Has subscribed to the Air France Canada Newsletter or has modified his profile on the following URL address between August 7 and September 20, 2009 before 23:59pm : http://home.edt02.net/emc/R/45720/formulaire/index.php. Members of the staff of the organizing companies and their families (same surname, same address) are not eligible. Participation in the contest supposes unreserved acceptance of the present rules and all their provisions, as well as of current rules of Internet ethics and of laws and regulations applicable to free contests. Failure to abide by the conditions set forth in these rules will result in the automatic disqualification of the entrant. Any attempt to disrupt the normal operation of this contest may result in the immediate elimination of the person involved. Winners agree that Air France can use their names and pictures for promotional or advertising purposes. By participating in this contest, the participants agree that all personal information submitted can be used. Nevertheless, these are only gathered for the purposes of the administration of the present competition and will serve at no other end without the consent of the participants. Article 3: ANNOUNCEMENT OF THE CONTEST The contest will be announced on www.airfrance.ca and in the Air France newsletters. The complete contest rules are available online on the contest form. Article 4: CONTEST PRINCIPLE To participate, all contestants must complete the online form found at: http://home.edt02.net/emc/R/45720/formulaire/index.php During their participation, the contestants are automatically entered in the draw. Article 5: DESIGNATION OF WINNERS A draw will be organized October 2nd, 2009 and designate the winner(s) among the senders whose participation has been validated. The draw will be conducted electronically, and the choice of winner is totally random. No list of winners shall be given out by telephone or by mail. The draw will be held at the offices of Air France at 2000 Mansfield, Suite 1510, Montreal, Quebec. Article 6: NUMBER OF TRIES PERMITTED Incomplete or inexact registrations will not be considered and will disqualify the entrant. Only one person per household may enter the contest: same surname, same address and/or same email address. Any person registering for the contest with several different email addresses shall be disqualified. Any attempt at fraud on the part of a participant shall disqualify all entries submitted from that household. Article 7: PRIZES The prize consists of: Two (2) Air France tickets (one pair) in Voyageur class (economy class) from Canada to France on Air France flights Total approx. prize value : $2,000 The winner and the person travelling with him/her must travel together on the outbound and return flight. The winner is responsible for travel expenses from domicile to the departure airport. ARTICLE 8: ATTRIBUTION OF PRIZES Informing winners and confirming prizes : The winners shall be informed of their prize by email on October 2, 2009, 5:00 p.m., Montreal time at the latest. If the winner does not make him/herself known within 30 days of the draw, he/she shall be considered to have refused the prize and no other winner shall be designated for that prize. Winners must abide by the contest rules. If one of the winners does not meet the criteria of the present rules, the prize shall not be attributed to him/her and shall remain the property of Air France. Prizes may under no circumstances be returned or exchanged for their value in money or for any other prize, nor transferred to a third party. However, in cases of force majeure or if warranted by circumstances, Air France reserves the right at any time to substitute other prizes of equivalent value for the announced prizes. No claims or disputes may be lodged in connection with the contest prizes. Winners agree to hold Air France harmless with regard to the prizes and in particular to their delivery, condition and quality. Winners must comply with the contest rules and manifest themselves by email to Rocca Ferri at roferri@airfrance.fr . If the winner does not meet the requirements of the present regulations his lot will not be allocated to him and would remain the ownership of Air France. To be eligible to the prize, the contestant whose name will be chosen randomly, will have to show that he/she meet all requirements of the present contest, and will be submitted to a mathematical test which he/she will have to answer within a specific delay, alone without any help, human, mechanical, electronic or any other one. Article 9: LIABILITY Air France may not be held liable in the event of a dysfunction on the Internet, preventing access to the game or its smooth running. In particular, Air France may not be held liable for any external acts of Internet abuse. While Air France shall do all in its power to provide users with information and/or tools that are accessible and verified, it may not be held liable for any errors (particularly in display on contest websites), or for the absence of availability of information and/or the presence of a virus on the website. Participation in the contest implies knowledge and acceptance of the characteristics and limitations of the Internet, the absence of protection of certain data provided against possible misuse or piracy, and the risks of contamination by viruses circulating on the Internet. Each participant must take the appropriate precautions to protect his/her own data and/or software on his/her computer or telephone equipment from any kind of attack. All persons connecting to the website and participating in the contest shall do so at their own risk. Furthermore, Air France is not responsible in the event of: problems with telephone connections, hardware or software problems, destruction for reasons not attributable to Air France of data provided by participants, human or electrically-caused errors, Disturbances that might affect the smooth running of the contest or dysfunctions in the automated draw process. Air France shall not be held liable for the consequences of any delay in email for which it is not responsible. Any claims must be sent by the recipient directly to the appropriate Internet service provider. Air France may not be held liable for any physical incapacity preventing the winners from taking the plane or for their being prevented from entering a foreign country due to an irregularity in their papers (absence or expiration of a passport, etc.). In any case, if the smooth running of the contest in administrative and/or technical terms is disrupted for any reason beyond the control of Air France, the Company reserves the right to suspend the contest. Any fraud or breach of the present rules shall result in the disqualification of the entrant; Air France reserves the right, if warranted, to initiate proceedings against the defaulting party. Article 10: DESIGNATION OF OFFICIAL BAILIFF FOR QUEBEC RESIDENTS ONLY: Any dispute regarding the planning and conduct of a contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any dispute regarding the awarding of prizes may be submitted to the Régie for the express purpose of helping the parties reach a settlement. The present rules are governed by the laws of Quebec. In case of any difference between the French and English version, the French version will prevail. |

Tickets must be used by May 31, 2010 and must have been issued by March 26, 2010. No extension shall be granted if not issued /used by said dates. |

Seats must be reserved in class “ Q or N ,” as per availability, 45 to 90 days in advance. |

Reservations requests must be faxed to Danielle Gauthier at 514 847 5034 or by email to mail.concours@airfrance.fr. You must provide 3 date options for both departing and returning, the names of the passengers as they appear on their passports, and the following information: email address, date of birth, passport number and country of issuance as well as its expiration date. |

Air France reserves the right to alter flight dates by a few days, after consulting with the ticket recipient, in the event of an unforeseen situation or a lack of seats in class “Q or N.” These tickets will be issued electronically. |

Tickets are issued at the same time reservations are processed. Air France will assume and pay all applicable taxes, including the fuel surcharge, at the time the tickets are issued. |

These tickets are for personal use and must be used simultaneously by both the winner and their travelling companion. Reselling these tickets is strictly forbidden. |
7. |
These tickets apply solely to the scheduled itinerary; they can neither be modified nor exchanged for tickets for a different itinerary. |

These tickets are not valid on other airlines. They cannot be used on Air France flight series AF 3600 to 3699, 4400 to 4499, 4600 to 4999, 6300 to 6399, 8000 to 9999, 7100 to 7199 and 7200 to 7299. |

These tickets do not allow for advance seat selection. Flying Blue miles cannot be earned on this trip. |

Air France will not be responsible for any failure to board due to circumstances beyond its control. Passengers shall assume all financial expenses or losses, e.g. hotels, restaurants, taxis, phone calls and lost wages, incurred as a result of said failure to board and shall waive all liability claims. |
